The terms and conditions of using this site and our services are provided below, if you have any questions feel free to ask.

(1) AGREEMENT BETWEEN USER AND RakeGuard.com

RakeGuard.com and all of its services rendered is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the site constitutes your agreement to all such terms, conditions, and notices.

(2) AMENDMENT OF TERMS OF USE

RakeGuard.com reserves the right to amend the terms, conditions, and notices at any time, for any reason deemed acceptable by the poker site. These amendments will take effect as soon as they are posted to this site. All amendments will be emailed to our members or placed into the announcements section of RakeGuard.com.

It is YOUR duty, when signing up to a poker room, to completely obey and understand the individual web sites terms and conditions. RakeGuard.com originates several codes and links and accepts no liability whatsoever for players who represent any false or misleading information which would constitute a breach of the governing rules and or regulations of the terms and conditions of any such poker room or online website they have registered with thru codes or links originating or relating to RakeGuard.com or any of RakeGuard.com's sub-affiliates.

You agree, thru your agreement with these terms and conditions that RakeGuard.com is not accountable for any personal, legal, ethical, financial or any other possible problems or losses which may or may not be related to, or in conjunction with any services that RakeGuard.com provides.

(3) CHARGEBACKS AND PAYMENTS

All Poker rooms have the right to withhold payments from RakeGuard.com in the event they believe that a player is using their poker account for fraudulent purposes. Examples include:

• Multiple accounts on the same network;
• Not having sufficient funds;
• Collusion;
• Any reasonable assumption on behalf of the poker room

Thus, any such room will hold the commission to RakeGuard.com for any such players under investigation. RakeGuard.com reserves the right to delay or refuse payment for any player or referrer who is under investigation or who willingly deposits with insufficient funds or writes fraudulent checks.

Any such fraud or actions will constitute a BREACH OF THIS AGREEMENT, and therefore, RakeGuard.com reserves the right to refuse or delay future payments and also to terminate your account.

(4) PLAYER STATS

The numbers we receive from any such poker room are the numbers used to calculate commission to RakeGuard.com. Therefore, these numbers are final and non-negotiable.

(5) BONUSES AND TRANSACTION CHARGES

All YOUR RakeGuard.com earnings are determined as a given percentage of Net Rake. Net rake can be reduced under several circumstances, including:

• Bonuses (deposits and give-aways)
• Usage of player points
• Transfers, deposit and cash-out costs
• Fraudulent or investigation fees (NSF checks, etc.)

All negative net rakes at the end of a month are carried forward to the next month regardless of whether the associated poker room resets negative balances for RakeGuard.com to zero. This is because RakeGuard.com's net rake for a poker room is calculated as a total of all players belonging to that room. Players registered to more than one account through RakeGuard.com will have their net rakes combined. If a player signs up for poker rake back and also chooses to play at that Poker room's casino or blackjack or any game besides poker, they will not be entitled to any revenue generated by their play; irrespective if RakeGuard.com is paid for such play.

(5) REFERRALS

RakeGuard.com's referral program entitles the referrer to earn a percentage of any rake generated by all the players they refer .

RakeGuard.com cannot control how players select to market RakeGuard.com to third parties, but we expressly condemn the following actions:

• Using the chat rooms of poker rooms, to solicit emails or online screen names
• Posting codes or links in any forum where such posts or messages would be considered “spam”
• Spam emails; and
• The use of any medium or action which is generally accepted to be unreasonable and/or unethical

YOU must be careful how you attract new players, and YOU are responsible for any people who may have access to your online account and who may play on your account.

RakeGuard.com will not tolerate any form of spamming, and if you are found to be in violation of this action, it will constitute a BREACH OF THIS AGREEMENT, and therefore, RakeGuard.com reserves the right to refuse or delay future payments and also to terminate your account.

If we receive any formal complaints from the Poker Rooms, we may be forced, upon investigation, to terminate the referral program for that player.

(6) LINKS TO THIRD PARTY SITES

RakeGuard.com contain links to other Web Sites, and are not under the control of RakeGuard.com. RakeGuard.com is not responsible for the contents, nor uses of any such Site. RakeGuard.com provides links to sites as a convenience, and the inclusion of any link does not imply endorsement of, or consent to, any actions by RakeGuard.com clients who visit such sites.

(7) NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the RakeGuard.com's services, you warrant to RakeGuard.com that you will not use the RakeGuard.com site for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

(8) LIABILITY DISCLAIMER

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH RakeGuard.com MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN.

RakeGuard.com MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON RakeGuard.com FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND.
